Hero Pools LLC ("Hero Pools," "we," "us," or "our") is a residential pool and spa service company providing weekly pool care, equipment repair, and specialty pool services to homeowners in Verrado, Arizona. We operate the website heropoolsaz.com and communicate with customers by phone, email, and text message.

This Privacy Policy explains how we collect, use, disclose, and safeguard personal information when you visit our website, request a quote, become a customer, or otherwise interact with us.   • Scheduling & Communication: To confirm appointments, send arrival notifications, and follow up on service visits via GoHighLevel.
  • Payments: To invoice and process payment for services rendered.
  • Marketing & Communications: To send emails and text messages about promotions, seasonal offers, and updates. You may opt out at any time (see Sections 8 and 9).
  • Advertising: To run targeted ad campaigns on Meta (Facebook/Instagram) and Google using audience and conversion data.
  • Customer Support: To respond to your inquiries and resolve service issues.
  • Analytics & Improvement: To understand how visitors use our website and improve our content and services.
  • Legal Compliance: To comply with applicable laws and to protect our rights.

We do not sell your personal information to data brokers or third-party marketers unrelated to the services described in this policy.

  • Service Providers & Processors: Vendors who perform services on our behalf, including our CRM/scheduling platform (GoHighLevel), website host, billing/payment provider, and advertising platforms. These parties are contractually required to protect your data and use it only as directed.
  • Legal Obligations: When required by law, subpoena, court order, or governmental authority, or to protect our legal rights, safety, or the safety of others.
  • Business Transfers: In connection with a merger, acquisition, sale of assets, or financing, your information may be transferred as a business asset. We will notify you if this occurs.
  • With Your Consent: For any other purpose with your prior explicit consent.

GoHighLevel acts as a data processor on our behalf for scheduling and client communication. Our billing and payment provider processes payment information directly; we do not store full payment card numbers on our own systems.

Do Not Track (DNT): Our website does not currently respond to browser DNT signals, as there is no uniform industry standard for recognizing or honoring them at this time. See Section 14 for our full CalOPPA DNT disclosure.

Meta & Google Advertising

We run paid advertising campaigns on Facebook and Instagram through Meta Platforms, Inc., and on Google Search and Display through Google LLC. As part of these campaigns, we may share hashed contact information (such as email addresses and phone numbers) with these platforms to create custom or similar audiences for ad targeting, and we use tracking pixels/tags on our website to measure conversions and engagement.

Meta and Google use this data in accordance with their own privacy policies. You can manage your ad preferences at facebook.com/adpreferences and myaccount.google.com/data-and-privacy.

The sharing of hashed contact data with Meta or Google for advertising purposes may constitute a "share" or "disclosure" under certain state privacy laws. California residents should review Section 13 for their specific rights regarding this activity.

SMS / Text Message Communications

By providing your phone number through our website, a quote request, or during onboarding as a customer, you consent to receive text messages from Hero Pools LLC via GoHighLevel, including:

  • Service-related texts: appointment confirmations, arrival notifications, and service updates.
  • Marketing texts: promotions, seasonal offers, and special announcements.
Message frequency varies. Message and data rates may apply. Consent to receive marketing texts is not a condition of purchasing any service. Reply STOP at any time to opt out of text messages, or HELP for assistance. You may also opt out by contacting us at [email protected] or 623-236-4023.

Opting out of marketing texts will not affect service-related texts tied to an active or scheduled appointment, unless you request otherwise. Carriers are not liable for delayed or undelivered messages. Text messaging originator opt-in data and consent will not be shared with third parties for their own marketing purposes.

Email Communications

We send transactional and marketing emails using GoHighLevel. Transactional emails (e.g., appointment confirmations, invoices) are sent as part of our service delivery. Marketing emails (e.g., promotions, seasonal reminders) are sent with your consent or on the basis of a legitimate interest where permitted by law.

Opting Out

You may opt out of marketing emails at any time by:

  • Clicking the "Unsubscribe" link at the bottom of any marketing email, or
  • Emailing us directly at [email protected] with the subject line "Unsubscribe."

We honor opt-out requests within 10 business days in accordance with the CAN-SPAM Act. Opting out of marketing emails will not affect transactional communications related to active service.

Data Retention

  • Customer records (name, contact info, service address, service history): Retained for the duration of our service relationship and up to 3 years after your last service or interaction, or as required for tax and legal compliance.
  • Marketing contacts: Retained until you opt out or request deletion.
  • Payment records: Retained for up to 7 years as required by financial recordkeeping regulations.
  • Website analytics data: Retained for up to 26 months, per Google Analytics' standard retention.

When data is no longer needed, we delete or anonymize it securely.

Data Security

We implement reasonable administrative, technical, and physical safeguards to protect your personal information against unauthorized access, disclosure, alteration, or destruction, including:

Sale or Sharing of Personal Information

We do not sell your personal information for monetary consideration.   • Right to Correct: Request correction of inaccurate personal information we hold about you.
  • Right to Opt Out: Opt out of the sale or sharing of your personal information for cross-context behavioral advertising.
  • Right to Limit Use of Sensitive PI: We do not currently collect sensitive personal information as defined by CPRA.

How to Submit a CCPA / CPRA Request

Email [email protected] with the subject line "CCPA Privacy Request." We will acknowledge your request within 10 business days and respond within 45 calendar days (up to 90 days if needed, with notice). We may need to verify your identity before processing your request. You may designate an authorized agent to submit a request on your behalf. We will not charge a fee for processing your request unless it is excessive, repetitive, or manifestly unfounded.

CalOPPA Disclosures

The California Online Privacy Protection Act (CalOPPA) requires operators of commercial websites and online services that collect personally identifiable information (PII) from California consumers to post a conspicuous privacy policy. The following disclosures are made in compliance with CalOPPA:
